Privacy Policy

Last updated: 29-09-2026

This Privacy Policy explains how Aqua Atlantis collects, uses, shares and protects your personal information when you shop with us online, in store, by phone or on WhatsApp, or when you visit aquaatlantis.co.za. We follow the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who we are

Aqua Atlantis is a specialist aquascaping, livestock and aquatic plant store in Cape Town. In this policy, “we”, “us” and “our” mean Aqua Atlantis.

2. What information we collect

  • Your name, email address, phone number, and delivery and billing addresses.
  • Your orders and purchase history, whether you buy online, in store, by phone or on WhatsApp, including what you bought, when, and how much you spent. We use your total spend to work out your Rewards Programme tier.
  • Your account details if you create an account on our website. Your password is encrypted and we cannot see it.
  • Messages you send us by email, WhatsApp, our contact form or social media.
  • Your marketing preferences, including whether you have signed up for or unsubscribed from our emails.
  • Information about how you use our website, such as your device and browser, pages and products you view, what you add to your cart, and whether you open or click our emails. Some of this is collected using cookies (see section 8).

We do not collect or store your full card details. Card and other online payments are processed directly by our payment providers, who confirm to us whether a payment was successful.

3. Where we get it from

Almost everything we hold comes directly from you: when you place an order, create an account, sign up for our emails, message us or buy in store. Some comes automatically from your use of our website, and some from our payment and delivery partners, for example confirmation that a payment went through or that a parcel was delivered.

4. Why we use it

  • To process and deliver your orders, including shipping livestock and plants safely, and to handle returns and queries.
  • To run our Rewards Programme and apply the discount your spend qualifies you for.
  • To communicate with you about your orders, deliveries and questions.
  • To send you marketing emails, as explained in section 5.
  • To improve our website and service, for example by understanding which products and pages are most useful.
  • To protect our business and our customers, including preventing fraud and keeping our systems secure.
  • To meet our legal obligations, such as keeping tax and accounting records.

We only use your information for these purposes, or for purposes closely related to them.

5. Marketing emails

If you have bought from us, we may send you emails about similar products, such as tank care tips, new arrivals and offers. If you have not bought from us, we will only email you if you have signed up.

Every marketing email includes an unsubscribe link. You can also ask us to stop at any time by emailing sales@aquaatlantis.co.za. Once you unsubscribe, we stop straight away. We keep a record that you unsubscribed so that you are not added again by mistake.

We will only send you marketing by WhatsApp or SMS if you have agreed to it. We never sell your personal information, and we never give it to other businesses to market to you.

6. Who we share it with

We share your information only with service providers who help us run the business, and only as much as they need to do their job. They must keep it confidential and secure, and may not use it for their own purposes. They include:

  • our website and online store providers (WordPress and WooCommerce) and our hosting provider;
  • our payment providers, currently Yoco, PayFast, Mobicred, RCS and our instant EFT provider;
  • courier companies, such as The Courier Guy, to deliver your orders;
  • Klaviyo, the platform we use to send our emails;
  • analytics and advertising tools we may use to understand and improve our marketing, such as Google and Meta;
  • our accountants and professional advisers.

We may also disclose information if the law requires it, or to protect our rights or someone’s safety.

7. Information stored outside South Africa

Some of our service providers, including Klaviyo, Google and Meta, store information on servers outside South Africa, mainly in the United States and Europe. We only use providers that are bound by agreements or laws that protect your information to a standard similar to POPIA.

8. Cookies

Cookies are small files stored on your device when you visit our website. We use:

  • Essential cookies that make the store work, such as keeping items in your cart and keeping you logged in;
  • Analytics cookies that help us understand how the website is used;
  • Marketing cookies that let us, for example, remind you about items left in your cart or show you relevant products.

You can choose which non-essential cookies to allow using our cookie banner, and you can block or delete cookies in your browser settings. Blocking essential cookies may stop parts of the store from working.

9. How long we keep it

  • Order, invoice and payment records: at least five years, as tax law requires.
  • Your account: until you ask us to close it, or after it has been inactive for a long period.
  • Marketing details: until you unsubscribe. After that we keep only the record that you unsubscribed.
  • Messages and queries: for as long as we need them to help you, and then for a reasonable period in case of follow-up questions.

When we no longer need information, we delete it or anonymise it.

10. How we protect it

We use reasonable technical and organisational measures to protect your information. These include a secure (SSL) website, access limited to the people who need it, and reputable service providers. If we believe your information has been accessed without authorisation, we will tell you and the Information Regulator, as POPIA requires.

11. Your rights

Under POPIA you have the right to:

  • ask what personal information we hold about you and request a copy;
  • ask us to correct information that is wrong or out of date;
  • ask us to delete information we no longer have a lawful reason to keep;
  • object to us using your information, including for marketing, at any time;
  • withdraw any consent you have given us.

To make a request, email sales@aquaatlantis.co.za. We may need to confirm your identity first, and we will respond within a reasonable time.

12. Children

Our store is aimed at adults. We do not knowingly collect personal information from anyone under 18 without a parent or guardian’s consent.

13. Changes to this policy

We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated at the top.
